DESCRIPTION OF PLATFORM MRichard333 Cybersecurity & Fraud-Prevention operates an educational social networking platform powered by HumHub software as a community service. Our Platform provides: - User profiles and social networking features - Discussion spaces and community forums - File sharing and collaborative tools - Educational content and resources - Group creation and management - Direct messaging and communication tools - Activity streams and notifications ## 3\. ELIGIBILITY AND ACCOUNT REGISTRATION ### Age Requirements and COPPA Compliance **IMPORTANT: Children Under 13** Our Platform is NOT intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are under 13, you may not use this Platform or provide any personal information to us. CHILDREN'S PRIVACY PROTECTION (COPPA COMPLIANCE) ### Our Commitment to Children's Privacy We are committed to protecting children's privacy and complying with the Children's Online Privacy Protection Act (COPPA). EDUCATIONAL CONTENT AND USER CONTRIBUTIONS ### Your Contributions You retain ownership of original content you create and post ("Your Content"). By posting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to: - Display and distribute Your Content within the Platform - Create backups and ensure platform functionality - Moderate and organize content for educational purposes - Share with other users as part of the social networking features Note: Any content from accounts deleted due to under-13 discovery will be permanently deleted and not used for any purpose. ### Educational Use License Your Content may be viewed, shared, and discussed by other Platform users for educational purposes. You understand that: - Your posts may be visible to other community members - Educational discussions may reference or build upon your contributions - Content may be preserved for educational continuity even if you leave ### Content Standards for Education Your Content must: - Be original or properly attributed if referencing other sources - Be appropriate for an educational environment suitable for users 13+ - Respect academic integrity and honesty - Comply with copyright and fair use principles - Be constructive and contribute to learning objectives - Not target or attempt to appeal to children under 13 ### Academic Integrity - Do not share answers to assessments or exams - Properly cite sources and give credit to others' work - Do not engage in plagiarism or academic dishonesty - Respect intellectual property rights ## 7\. INTELLECTUAL PROPERTY AND EDUCATIONAL USE ### Platform Rights The HumHub software, our customizations, and original platform content are protected by intellectual property laws. CAD $100 (One Hundred Canadian Dollars) 2. The amount you paid us in the preceding 12 months (typically $0 for free services) **EXCLUDED DAMAGES:** WE SHALL NOT BE LIABLE FOR ANY: - Indirect, incidental, punitive, or consequential damages - Loss of profits, revenue, data, or business opportunities - Educational setbacks, academic failures, or missed opportunities - Emotional distress or mental anguish - Costs of substitute services or platforms - Damages resulting from third-party actions or content - Security breaches or data incidents beyond our reasonable control **TIME LIMITATIONS:** Any claims must be brought within 6 months of the incident giving rise to the claim, or such claims are forever barred. **COPPA COMPLIANCE EXCEPTION:** This limitation does not affect our legal obligations under COPPA to protect children's privacy and respond to legitimate parental requests. ## 13\. You consent to the personal jurisdiction of such courts and waive any objection to venue. ### Non-Profit Protections We operate under Canadian non-profit legislation, which may provide additional protections and limitations on liability beyond those specified in these Terms. ### Language These Terms are drafted in English.
